1. What is 311?

311 is a simple three digit number residents, businesses and visitors can call to reach the City to get information, request services and report problems. From requesting a replacement garbage tote to reporting a stray dog in your neighborhood and a whole lot more, 311 is ready to help.

2. Why was 311 created?

The 311 service is part of an ongoing effort by the City of Buffalo to provide access to City government easier and more responsive to the needs of residents, business owners and visitors.

3. Who can call 311?

Anyone within the Buffalo city limits area can call 311 free of charge from a land or cellular telephone (pay phone and cellular phone airtime charges do apply).

4. When can I call 311?

Customer service representatives are available during the hours of 8:30 a.m. to 4:30 p.m., Monday through Friday. However, you can leave a message after working hours and an operator will enter the call for you the next business day.

5. What if I need to call 311 from outside the City limits?

People outside of the City of Buffalo city limits, including cell phone users, can reach 311 customer service representatives by calling 716-851-4890.

6. Is it a free service?

There is no charge for using 311. There is also no additional service assessment or fee that will be collected for 311 by your phone company. However, this is not a free call for pay phone users. Also, depending on your plan, your cellular phone company may charge minutes for this call.

7. When do I use 311, and when do I use 911?

The 911 service is for emergencies, such as house fires and crimes in progress that require an immediate response by police, fire crews, or an ambulance. For all other city services, call 3-1-1.

8. Anymore information on the 311 Call & Resolution Center?

The City of Buffalo 311 Call and Resolution Center, formerly known as the Mayor's Complaint Line, was created in July of 2000. The City of Buffalo Call and Resolution Center has improved communications with the general public and all of the city's stakeholders, which have created a more responsive and efficient process to request city services. The call center allows access to all City of Buffalo services, information and non-emergency police services. Residents can call 311 or 851-4890 to report service needs, check the status of previous service requests, obtain information regarding city programs or events and take care of non-emergency police matters. Service requests can also be submitted and then tracked over the Internet by utilizing the City of Buffalo's Self Service Portal.

Each service request is assigned a service number and the caller is sent an acknowledgment letter informing them of who will provide the service and an expected date for resolution.

1. Who is eligible to obtain a birth certificate copy?

WHO IS ELIGIBLE TO OBTAIN A BIRTH CERTIFICATE COPY?

• The person named on the birth certificate.
• A parent of the person named on the birth certificate (requesting parent's name must be listed on the birth certificate)
• Only by order of a New York State Court or a Government agency for a legal or proper purpose may a spouse, child or other persons obtain a copy of a birth certificate.
• If you have custody of a minor under the age of 18, you will need custody papers that are no older than 6 months otherwise you must obtain an updated copy from the court.

3. How Can I Request a Birth Certificate?

Birth Certificate Request - for the City of Buffalo Only

• REQUESTING A RECORD IN PERSON: You must provide government issued photo ID.  The fee is $10 per certificate payable by money order, MasterCard®, Visa® or cash.

• Note: Wallet-sized photo birth certificates are available (only in person) for $25. The same criteria applies if you were obtaining a hardcopy birth certificate.

• REQUESTING A RECORD VIA INTERNET: For your convenience you may process online requests through VitalChek Network, Inc. an independent company. They can be reached either online at www.vitalchek.com or by phone at 800-255-2414. An additional fee is charged by VitalChek for using their service. They accept all major credit cards. The City of Buffalo is not responsible for the operation of this service. VitalChek assumes all liability.

• REQUESTING A RECORD VIA MAIL: Orders are processed within 7-10 days from receipt of mail request.  The following information must be included:

• Enclose a written request with the following information: name on birth certificate, date of birth, hospital, father’s name, mother’s maiden name, contact phone number

1. Answering a Ticket

If you were issued a non-criminal Uniform Traffic Ticket for a traffic infraction in the City of Buffalo, it will be handled by the Buffalo Traffic Violations Agency. 

TO PLEAD GUILTY:

Read the instructions and sign Section “A” of the ticket. Fill in the requested information and return to agency. You will be contacted by mail. Upon review of your driving history, you may be offered a reduced plea. If a plea cannot be offered, or if you do not wish to accept the plea, you will be scheduled for a hearing before a Judicial Hearing Officer. The original plea offer will not be available at your hearing.

If you don’t answer the ticket in the time allowed, your driver’s license will be suspended. Driving with a suspended license is a crime. A felony conviction may result in fines of up to $5,000, DMV sanctions, and/or confiscation of your vehicle. 
Later, you could be found guilty by default because of your failure to respond. Failure to pay would result in a judgment entered against you.

2. Payment

Fines must be paid on or before the date payment is due. If you are unable to pay your fine on the date it is due, you must contact the agency to request additional time to pay or enroll in a payment plan arrangement.

Important Additional Information

Failure to your fines, fees, or surcharges will result in a judgment entered against you. Motorists and registrants charged with a violation of Vehicle & Traffic Law Section 385 are subject to license suspension for failure to pay. Driving with a suspended license is a crime. A felony conviction may result in fines of up to $5,000, jail, probation, or confiscation of your vehicle. 

Payment Plans

Pursuant to Chapter 382 of the Laws of 2020 and Chapter 76 of the Laws of 2021, payment plans are available for fines, fees and mandatory surcharges incurred as a result of a violation of the vehicle and traffic law. 3. Trials

If you are scheduled for Traffic Court, your case will be heard by a Judicial Hearing Officer, an experienced judge with special training in the Traffic Laws. A Judicial Hearing Officer has the authority to decide whether or not you are guilty and to set a fine if you are found guilty. 

A Judicial Hearing Officer also has the authority to revoke or suspend your driver’s license when required by law or when the Judicial Hearing Officer believes it is in the interest of traffic safety. Just as in traffic courts in other areas of the state, you may present witnesses and evidence at your trial and you have a right to be represented by an attorney. 

If you fail to appear for trial, your driver’s license will be suspended and you could be found guilty by default because of your failure to appear. Failure to pay would result in collections actions and a judgment would be entered against you.

Time & Location

Traffic Court is held several days per week. Court sessions are scheduled from 9:30 a.m. until 4:00 p.m.

• If you are scheduled for a hearing, you must appear on the date and time listed on the appearance notice you received. 
• Bring your hearing notice with you.
• Photo ID is required.
• Please allow yourself ample travel time in order to find parking and to pass through security. You will be required to pass through a metal detector when entering the building. Cell phones must be turned off at all times. Don’t forget to bring quarters and dollar bills for the parking meters. Pay-by-cell available in all zones.
• Failure to appear may result in a Default Conviction.

Virtual Trial Option

If you have an upcoming trial, you may choose to participate remotely over video/audio conferencing software.

Requirements for a Virtual Trial

• You must have a video and audio enabled device (laptop, smartphone, tablet, etc)
• You must APPEAR ON VIDEO. If you attempt to join without video, you will not be admitted to the virtual courtroom and you will be considered Fail To Appear.
• You must log into the secure virtual traffic court meeting link at least 10 minutes before your scheduled hearing time. *You will be muted until your case is called*
• Cisco WebEx Meetings can be accessed using your PC's browser, or via the Cisco WebEx Meetings app on your mobile device.
• It is STRONGLY recommended that you test the site and download the app in the days before your court date.
• Have your photo ID ready for identification verification. Your face must be visible during your hearing.

4. Certificates of Disposition

A Certificate of Disposition is an official court document affixed with the Court Seal that says what happened in a criminal case. It says the violation you were charged with, what you were convicted of, the date you were convicted and the sentence (fine) imposed. Pursuant to NYS Civil Practice Law and Rules §8021[c][1]; Judiciary Law §255, the fee for a “certificate of disposition” is $5.00. 

If your case was disposed of prior to July 1, 2015 your case file remains in the custody of the DMV and the records cannot be accessed by this agency. You must contact the DMV in Albany at 718-488-5710.

5. Traffic Prosecutor

Buffalo Traffic Prosecutors serve the agency by prosecuting traffic violations. The prosecutors appear at all judicial hearings. Defense attorneys are encouraged to contact the prosecutor by mail or fax (716) 851-9695, or email ovillegas@buffalony.gov.

6. License Suspension "Scofflaw"

If your license is suspended due to Failure To Appear "Scofflaw," the suspension will be lifted when you Answer. 

To "Answer" means appearing in person at the agency or contacting the agency via email or mail.

7. Appeal After a Guilty Verdict

If you disagree with the decision of the Court, the appropriate action is to file an Appeal. You have a right to appeal a conviction and sentence within timelines set by law. The Buffalo Traffic Violations Agency is a court of record and the appeal process is governed by the Criminal Procedure Law. Appeals must be made through a superior court and are not made directly through the agency.

8. Default Convictions

What is a Default Conviction?

A default conviction is filed against a defendant-motorist when he/she fails to appear for a scheduled trial or hearing. When a defendant-motorist fails to appear as scheduled, maximum fines and surcharges allowed by law could be assessed and a default conviction is recorded and transmitted to New York State Department of Motor Vehicles.

9. Scofflaw/Default Judgment

What is a Scofflaw/Default Judgment?

A Scofflaw/Default Judgment is filed against a defendant-motorist when he/she fails to timely answer a ticket. Maximum fines and surcharges allowed by law are assessed. The Scofflaw/Default Judgment is recorded and transmitted to New York State Department of Motor Vehicles.

11. Adjournments

• TO ADJOURN YOUR PRE-TRIAL CONFERENCE:

If you are scheduled for a pre-trial conference, you may request your conference to be rescheduled to a different date. The Prosecutor’s Office must receive your request at least 24 hours before the date of the conference. 
Any further adjournments will be considered and granted at the sole discretion of the Prosecutor’s Office. Your request for a second or subsequent postponement should include a "good cause," which is the reason you want the conference rescheduled.

• TO ADJOURN YOUR TRIAL:

You may request your trial to be adjourned and rescheduled to a different date. This may be done one time and one time only. The agency must receive your request at least 10 days before the date of the trial. Your request must include "good cause" for your trial to be postponed. Your “good cause” is subject to approval by the Judicial Hearing Officer. The agency must receive notice of your request at least 10 days before the date of the trial. No second requests for adjournments will be considered by the Court.

12. Dismissals on Proof

EQUIPMENT:
Many equipment violations may be dismissed if timely repaired. To prove such a repair, an affidavit must be filled out and signed by a police officer or a DMV approved inspection station mechanic. The affidavit must be completely filled out and submitted with your plea. You MUST KEEP a COPY of the affidavit in case it is lost in the mail or otherwise. If you are unable to produce an affidavit or copy of the affidavit, the summons will be subject to review by the Prosecutor’s Office. 

For equipment violations under the Vehicle & Traffic Law, use the VTL Correction Form.

For equipment violation under the Transportation Law (for Commercial Motor Vehicles), use the CMV Correction Form.

INSURANCE:
If you are charged with an insurance violation, you may provide proof that the vehicle was insured on the date the violation was issued. Proof of insurance may only be considered by providing a letter from the Insurance Company (not an insurance broker). The letter must provide specific information and most insurance companies know what to put in the letter. Insurance cards, policies, etc. are NOT acceptable as proof of insurance, only a specific letter as indicated is acceptable. If the letter is sufficient to prove the vehicle was insured on the date in question, no fine or surcharge will be imposed. The maximum fines for uninsured vehicles can be up to $1500 and carries an $88 surcharge. A plea of guilty or conviction for uninsured vehicle will also carry a civil penalty of $750 from the Department of Motor Vehicles as well as the revocation of your driver’s license for one year.

INSPECTION:
Summonses for uninspected vehicles may NOT be cured by getting the vehicle inspected. If the vehicle was not inspected at the time the summons was issued, there is no way to correct said violation.

REGISTRATION:
Summonses for unregistered vehicles may NOT be cured by getting the vehicle registered. If the vehicle was not registered at the time the summons was issued, there is no way to correct said violation.

14. Internship Opportunities for Law Students

Internship Opportunities
The Buffalo Traffic Violations Agency (Buffalo Traffic Court) offers law students the opportunity to serve an unpaid internship during their Fall, Spring, or Summer semesters.   If accepted into the program, students will be mentored by the City Traffic Prosecutor having overall supervision of the program.  During their internship, students will perform a full range of law clerk responsibilities, including research and writing and will have the opportunity to observe live courtroom activity.  Students participating in the program will also attend court proceedings, meetings with defendants and defense attorneys, depositions and other special events.   Assignments will be focused in areas of traffic laws and criminal procedure.

5. I requested a hearing, buy have not heard anything yet. Why?

We do not send out hearing notices until approximately three weeks prior to your scheduled hearing date. Hearing requests are processed in the order they are received and may take months to schedule depending on the volume of hearing requests pending. 6. Who can request a hearing?

• Anyone can request a hearing, however, Hearing Notice will be sent to owner of property or person cited, if different.
• Written notarized consent is required for representative to appear at a hearing. Refer to Hearing Notice for further information. Authorization form is contained at bottom of Hearing Notice.

7. Can I reschedule my hearing?

8. Can I cancel my hearing and make payment instead?

Yes, you can cancel hearing and make payment at any time prior to the scheduled hearing date. If Hearing Request was not made timely, payment must include original fine amount and applicable late penalties. 9. I received a Notice of Failure to Appear at my hearing, what do I do now?

• To avoid judgement, you must make immediate payment of the balance due as indicated on the notice.
• You may make application in writing to open the default citing good cause for missing your hearing and your defense to the violation.

10. What if I cannot afford to prepay the fine amount to appeal?

11. What if I cannot afford to pay the fine amount by the due date on the Hearing Disposition?

• You are given 30 days at the hearing to pay or appeal a guilty verdict. Absolutely no extensions are granted. Failure to pay by the due date will result in the summons going to the maximum amount as indicated on the hearing disposition and entry of a judgement.
• If you cannot pay and would like to enter into a payment plan, please contact our office at 716-851-4046 prior to the due date to determine if you are eligible. If eligible, you will be required to make your initial payment prior to the due date.

Customer service representatives are available during the hours of 8:30  a.m. - 4:30 p.m. Monday - Friday. However, you can leave a message after working hours and an operator will enter the call for you the next  business day.

8. Who assures that asbestos has been removed from buildings that are to be demolished?

New York State requires that a licensed third party certifies that the asbestos has been removed. A copy of this certification is required as a condition of the permit and must be received before a permit can be issued.

9. Can I remove asbestos from my own single family home?

Only if it is a 1-family owner-occupied home, an owner can remove asbestos from their own home. If it is a 2-family dwelling or more, or a commercial/industrial building, a licensed New York State certified contractor must do asbestos abatement. The owner of a 1 family occupied home can remove asbestos, but it must be properly disposed of. The home owner can put it to the curb, but the City of Buffalo reserves the right to not pick it up. It is recommended that the owner water-soak asbestos prior to removal, and double-bag it in contractors' garbage bags. The dog license tag provides identification if your dog were to be lost or stolen and also protects the public health by preventing the spread of rabies from dogs to humans. This includes a copy of the certificate, a three-year search of the index, and either a copy of the record or a no record found. When more than a three-year search is requested, the fee is higher.

Look at the bottom line on our bill, entitled "Notice of Impending Judgement." You will see a box listing information pertaining to the summons. Look over to the box entitled "Amount Paid." If the amount in the box corresponds to the amount you paid, you are being billed for one of the following:

5. My vehicle was booted/impounded. What do I do?

If your vehicle has a wheel lock attached or it has been impounded, call the Impound Lot at 716-851-5369 or visit in person at 166 Dart Street.  

To get a breakdown of fees ahead of time please contact the Impound Lot at 716-851-5369. All outstanding summonses and fees against the registered owner and/or titleholder must be satisfied before a vehicle release is given. Please click here for our impound procedures. 

If you received a letter from our auto impound regarding a vehicle you no longer own, please disregard the letter.  It is our responsibility to notify the last titled owner.

The vehicle must be registered and insured and all towing and storage charges satisfied in order to obtain a release form.

*Only for impounded vehicles, not for accident vehicles.

7. When do you have to follow parking regulations?

You have to park legally every day of the year; there are no exceptions for holidays.

8. What holidays do you not have to pay at parking meters?

Sundays and Legal Holidays are excluded. Holidays are New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day only.

9. How do you know where a bus route is?

You can visit the NFTA-Metro Website or see the List of Bus Routes, per the NFTA.

From November 1st to April 15th, parking on a Bus Route is prohibited between the hours of 1:30AM-7:00AM.  

10. How do I request a hearing?

Hearing requests can be made by email, phone or by mail. Please include the summons or the bill you have received from us, along with your current name and address. We will notify you by mail of your appointment. You may appear any Tuesday, Wednesday, or Thursday on or before the scheduled date between 9 a.m. and 12:30 p.m. or 2 p.m. and 3:30 p.m. to have your hearing. Hearings cannot be rescheduled. If you want to cancel your hearing and pay, payment can be made by mailing your check or money order for the amount due along with your hearing notice. Payment must be either in person or postmarked by mail no later than the appointed hearing date. • If you have received a bill and feel you have already paid it, check the paid column on the notice.  If an amount appears, this billing is due to your payment being postmarked after the due date or you did not pay the full amount of your ticket.  You must pay the additional penalty or mail in your notice requesting a hearing.  A determination must be made by a hearing officer.
• If you feel you did not receive the summons listed on the bill, check the information listed.  If all information is accurate, make payment or request a hearing by the due date. Parking Violations Bureau does not grant any payment extensions.
• If the registered owner of the vehicle is deceased, mail in a copy of the death certificate or obituary. If the summons was issued on or before the date of death, the summons will be cleared.
• If the vehicle was stolen, send in a copy of the police report with the date and time the car was reported stolen and date and time the car was recovered.  If the summons was issued between this time frame, the summons will be cleared.

12. How do I dispute a broken meter or a signage problem?

If you have received a ticket at a meter or are disputing alleged sign posting, mail the summons to us with a detailed explanation of the problem along with your current name and address. We will investigate the problem, and the results will be mailed to you with an explanation.

If you are on the street and notice a meter is broken, please contact 311 and let them know the meter number and street it’s located on. They will dispatch an Mechanic to repair any issues.

1. WHAT IS THE SCHOOL ZONE SAFETY PROGRAM?

The School Zone Safety Program protects children and pedestrians by using automated speed cameras to ticket motorists exceeding the speed limit in school zones.

2. HOW DOES IT WORK?

If a car is speeding through a school safety zone, photographs and video are recorded and the registered owner of the speeding vehicle will receive a speeding citation in the mail. Each violation is reviewed by several levels of trained technicians to verify vehicle information, and photo and data quality. Photographs are taken of the rear plate of the vehicle and the driver is not visible on the citation.

3. WHERE ARE THE AFFECTED SCHOOL ZONES?

A list of affected school zones can be found on this webpage. Warning signs and flashing beacons are displayed at each affect zone warning motorists that photo enforcement is in use. Please visit this page for the complete list of affected zones and any updates. Automated speed enforcement will be in effect up to one hour before and after arrival time; one hour before and after dismissal time; as well as one half-hour before and after extracurricular activities.

4. WHY IS THIS HAPPENING?

Speeding is a factor in one-third of all fatal crashes in the United States and remains in the top reasons for child fatalities. Mayor Byron Brown is committed to taking action to address speeding and calm traffic. This program is the next step in the Mayor’s response to citizens input and 311 concerns.

5. ARE SPEED ENFORCEMENT CAMERAS LEGAL?

Yes, recent changes in state laws now allow Buffalo to use automated speed enforcement technology.

6. WHEN DID THE SCHOOL ZONE SAFETY PROGRAM START?

While Buffalo Public Schools remain remote learning, a number of private schools and daycares have reopened.

Cameras resumed capturing violations beginning October 13, 2020. Violations of speeding in a school zone will carry a fine of $50.00. The responsible party is the registered owner pf the vehicle regardless who was driving.

7. CAN I CHALLENGE MY CITATION?

Yes. You have the right to request a hearing under a number of valid defenses. To request a hearing, please refer to the back page of your citation. Hearings may be requested in person, by mail, or over the telephone.
